General Terms of Use for AI Content 360°

1.Introduction
These Terms of Use ("Terms of Use") govern the use of the Artificial Intelligences behind AI Content 360° ("AI Content 360°", "we", "us" or "our"). As part of the registration process, you will be asked to agree to, among other things, our AI Content 360° Terms of Service by clicking in the appropriate checkbox (OptIn). If you do not agree to these Terms of Use, you may not use AI Content 360°, and registration is not possible without agreeing to our Terms of Use.
2. right of use
Subject to these Terms of Use, we grant you a non-exclusive, non-transferable, revocable right to use AI Content 360°, which is limited in scope of use as well as in time and content.
3 Intellectual Property
No further legal positions in AI Content 360° may be derived from the right of use granted. You acknowledge that all right, title and interest in and to AI Content 360°, including any patents, copyrights, trademarks, trade secrets and other intellectual property rights, shall remain the property of AI Content 360° or its licensors, without limitation to said legal positions. You may not claim or grant any right, title or interest in AI Content 360°, and you must comply with all applicable intellectual property laws and regulations.
4. prohibition of multiple registrations
You agree not to make multiple registrations with AI Content 360° by using different email addresses or other means of identification. Each person may create and use only one account with AI Content 360°. Multiple registrations may result in immediate suspension or deletion of all affected accounts. This policy is in place to prevent abuse, ensure compliance with usage restrictions, and maintain the integrity and fairness of the AI Content 360° service for all users.
5 Minimum age for use
To use AI Content 360°, you must be at least 13 years of age or the minimum age of consent for the processing of personal data in your country, whichever is higher. By using AI Content 360°, you represent and warrant that you have reached the minimum age required and are authorized to consent to these Terms of Use. If you have not reached the required minimum age or are otherwise not eligible to agree to these Terms of Use, you may not use AI Content 360°. In particular, children may not use AI Content 360° unless they have been permitted to do so by a parent, guardian or other authorized adult. For purposes of these Terms of Use, a person under the age of 13 or a person who has not reached the minimum legal age to consent to the processing of personal data in the country in which the child resides is considered a child. In Germany, the legal minimum age is 16. Parents or legal guardians who, in the above sense, allow their children to use AI Content 360° are responsible for the actions and activities of their children in connection with AI Content 360° and undertake to ensure compliance with these Terms of Use.
6. user obligations
As a user of AI Content 360°, you agree to use AI Content 360° in accordance with applicable laws and regulations. In particular, you agree not to use AI Content 360° for the following purposes:
a. Infringing any copyright, trademark, trade secret or other rights of any third party.
b. The distribution of illegal, offensive, defamatory, discriminatory, threatening, violent, pornographic, child pornographic or obscene content.
c. The distribution of images, pictures, graphics, photographs, or other materials depicting death, violence, or serious injury in extreme graphic or pictorial detail.
d. The distribution of sexual content , involving a person under the age of 18, or content intended to arouse sexual excitement, the description of sexual activities (except didactically prepared sex education materials), or the advertising of sexual services.
e. The dissemination of content that promotes, encourages, or depicts acts of self-harm, such as suicide, self-harm, and eating disorders.
f. Inciting or promoting hatred, discrimination, or violence against any person or group, particularly on the basis of race, ethnicity, religion, gender, sexual orientation, physical or mental limitations, or other grounds.
g. Engaging in or supporting illegal activities, including but not limited to fraud, hacking, phishing or distribution of malware.
7. handling of personal data
As a general rule, you agree not to provide AI Content 360° with any personally identifiable information, such as first name, last name, addresses, telephone numbers, email addresses, or any other information that could identify an individual. Before submitting such data, you must make it anonymous, for example, by using pseudonyms or other non-identifiable information. By complying with this requirement, you will help to maintain the privacy and protection of personal information of all participants and ensure compliance with applicable data protection laws and regulations.
8 Upload of Images
Uploading images (photographs, graphics, drawings and the like) is only available to verified users of AI Content 360°. When uploading images, you represent and warrant that you own all rights to such images and that the images do not contain any illegal content or violate these Terms of Use. You agree not to upload any images that infringe any trademark, copyright or personal rights, and not to upload any images that violate the content guidelines set forth in Section 6 of these Terms of Use.
AI Content 360° reserves the right to remove images that violate these Terms of Use without prior notice and to take appropriate action against the user, including but not limited to account deactivation or deletion, as described in Section 9 of these Terms of Use.
9 Violation of the Terms of Use and Consequences
If you violate one or more provisions of these Terms of Use, we reserve the right to deactivate or delete your account without prior notice. Deactivation or deletion of your account may result in immediate termination of your access to AI Content 360° and all related services. This action is taken to protect the integrity, security and quality of AI Content 360° and to comply with applicable laws and regulations.
10. Content Errors and Review of AI Results.
The results generated by AI Content 360° may contain content errors and may not always be accurate or reliable. You are responsible for checking each generated result for plausibility, accuracy, completeness and relevance before sharing or using it. Do not rely solely on the information provided by AI Content 360°, especially in critical or sensitive situations. Mass processing or the creation of texts without proper verification is not permitted, as this may result in the dissemination of erroneous or misleading information. When using AI Content 360°, it is your responsibility to ensure that the generated results comply with applicable laws, regulations and the requirements of your respective field of application. This includes, in particular, the legal review of the extent to which the generated content may be published or exploited.
11 Availability and updates
AI Content 360° reserves the right to modify, update, extend, limit or discontinue the Service at any time. We cannot guarantee that AI Content 360° will be available or error-free at all times. We assume no liability for the temporary or permanent unavailability of AI Content 360° or for any updates that result in a change in functionality, performance or availability.
12 Limitation of Liability
AI Content 360° is provided "as is" and without warranty of any kind. We shall not be liable for any direct, indirect, incidental, or consequential damages arising out of the use or non-use of AI Content 360°, including, but not limited to, lost profits, business interruption, or loss of data. Excluded from the above limitation of liability is the liability for damages resulting from injury to life, body or health, which are based on an intentional or negligent breach of duty by AI Content 360°or an intentional or negligent breach of duty by a legal representative or vicarious agent of AI Content 360°. The same applies with regard to liability for other damages based on a grossly negligent breach of duty by AI Content 360°or an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of AI Content 360°.

14. continuance of the provisions
The provisions of these Terms of Use that by their nature or express provision are intended to survive termination or cancellation will remain in effect after termination or cancellation of the User Agreement between you and AI Content 360°. This includes, but is not limited to, limitations of liability, intellectual property provisions, and with respect to applicable law.
15 Changes to the Terms of Use
We reserve the right to change these Terms of Use at any time without prior notice. Your continued use of AI Content 360° after such changes constitutes your acceptance of the modified Terms of Use.
16 Applicable Law and Jurisdiction
These Terms of Use shall be governed by the laws of the country in which AI Content 360° is located, without regard to its conflict of law provisions, if any, and the laws of the Federal Republic of Germany shall apply. All disputes arising in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of that country. Stuttgart is hereby agreed as the place of jurisdiction. Insofar as you as a user are a "consumer", the so-called "flying jurisdiction law" shall apply to the so-called consumer contract concluded with you in Germany, i.e. the consumer may choose the place of jurisdiction where he has his place of residence.
